Terms & Conditions
These terms explain how LuckyFish gifts work, what you can expect from us, and what we expect from you. Please read them before you buy. By buying or using a LuckyFish gift, you agree to them.
1. Who we are
LuckyFish is a trade name of Invictus & Marketing Advisory LLC (“LuckyFish”, “we”, “us”), a Virginia limited liability company. You can reach us at gifts@youluckyfish.com. LuckyFish is an Invictus Advisory venture.
2. How LuckyFish gifts work
- You (the “buyer”) choose an experience near a college campus and buy it as a gift for someone (the “recipient”).
- After payment, we email the recipient a gift with a unique gift code, and email you a receipt.
- Each experience is provided by an independent local business (the “experience provider”). The recipient books a date directly with them and shows the gift code when they arrive.
- You must be at least 18 years old to buy a gift, and the details you give us, including the recipient’s email address, must be accurate.
3. Prices and payment
- All prices are in US dollars and are the total you pay. There are no extra booking fees, service fees or delivery charges.
- Payments are processed securely by Stripe. We never see or store your full card details.
- The price includes our service for curating and delivering the gift. Part of what you pay goes to the experience provider and part to LuckyFish.
- We may change prices for future purchases at any time. A gift you have already bought is not affected.
4. Using a gift
- Each gift is good for the experience named, or its gift value (shown in the gift email) toward any other service from the same experience provider. The gift value is the experience provider’s own price for the experience. It is lower than the price you pay, because our price includes LuckyFish’s service.
- Upgrades: if the recipient chooses something more expensive, they pay the difference directly to the experience provider.
- Cheaper choices: if they choose something less expensive, the remaining value stays as credit with that experience provider. It is not paid out in cash, unless the law where the gift was bought requires it.
- Bookings depend on the experience provider’s availability, opening times, seasons and booking policies, including their cancellation and no-show rules. Please book early for busy times.
- A gift code can be used once. Keep it private: anyone who has the code may be able to use it. We are not responsible for a code used by someone else after it was shared, lost or stolen, but contact us straight away and we will help where we can.
- Gifts can be passed on to someone else, but cannot be resold.
5. How long gifts last
Every gift is valid for at least 5 years from the date of purchase. The exact date is shown in the gift email. We never charge inactivity, dormancy or service fees, and a gift’s value never decreases over time.
6. Refund policy
In short: all gift purchases are final and can’t be refunded if you change your mind. Every gift stays valid for 5 years, and if the experience can’t be provided, we’ll make it right.
All sales are final
Because the experience provider is paid when you buy, LuckyFish gifts are non-refundable. Once a purchase is complete, it can’t be cancelled, refunded or exchanged for cash because you or the recipient changed your mind, or because the gift wasn’t used before it expired. Please check the experience, the location and the recipient’s email address before you pay.
The recipient doesn’t have to book straight away. They can book whenever suits them while the gift is valid (at least 5 years), and they can put the gift value toward any other service from the same experience provider.
Payment errors
If you were charged twice for the same gift, charged the wrong amount, or charged for a purchase you didn’t make, email gifts@youluckyfish.com and we will correct it, including refunding any charge made in error.
If the experience can’t be provided
If an experience provider closes, stops offering the experience, or can’t honour a valid gift, contact us. We will offer the recipient an equivalent experience or refund the buyer the full price paid, whichever the buyer prefers. This applies for the whole time the gift is valid.
Wrong email address or lost gift
If the recipient’s email address was wrong, or the gift email was lost, contact us. As long as the gift hasn’t been used, we’ll resend it, or send it to the correct address.
Problems with the experience itself
Please raise problems about the service you received (quality, timing, staff) with the experience provider first. If that doesn’t resolve it, email us and we will work with the provider to find a fair outcome.
How refunds are paid
Where a refund applies under this policy, it goes back to the original payment card, usually within 5 to 10 business days. Once a gift is refunded, its code is cancelled and can no longer be used.
Nothing in this policy limits any rights you have under applicable law.
7. Experience providers
Experience providers are independent businesses. They, not LuckyFish, provide the experiences and are responsible for them, including their safety, staff, licences, insurance, facilities and the service delivered. Descriptions and photos on our site are provided in good faith, but providers may change details such as menus, schedules or equipment.
8. Safety, age limits and risk
- Some experiences have age, height, weight, health or skill requirements, or need a signed waiver. The experience provider sets these and may refuse service if they aren’t met. Please check before you buy.
- Experiences involving alcohol (such as wine or brewery tastings) are only for recipients aged 21 or over, with valid ID.
- Outdoor and adventure activities such as skiing, rafting, ziplining and mountain biking carry risks of injury. The recipient takes part at their own risk and must follow the provider’s safety instructions.
- Weather or safety conditions may mean an activity is rescheduled. The provider’s rescheduling policy applies.
9. Your responsibilities
Don’t use LuckyFish for fraud, to buy with a card you aren’t allowed to use, or to send messages that are abusive or unlawful. We may cancel gifts bought fraudulently, and refuse or cancel an order if a price was clearly shown in error. If we cancel an order for a pricing error, we refund it in full.
10. Our responsibility to you
- We are responsible for selling and delivering your gift as described in these terms.
- To the extent permitted by law, we are not liable for the acts or omissions of experience providers, or for injury, loss or damage arising from taking part in an experience.
- To the extent permitted by law, our total liability to you for any claim about a gift is limited to the amount you paid for that gift, and we are not liable for indirect or consequential losses.
- Nothing in these terms excludes liability that cannot be excluded by law.
11. General terms
- Changes: we may update these terms. The version in effect when you bought a gift applies to that gift. We will show the new effective date at the top of this page.
- Law: these terms are governed by the laws of the Commonwealth of Virginia, without affecting any consumer protections you have where you live.
- Disputes: please contact us first. Most problems can be sorted out quickly by email.
- Whole agreement: these terms and our Privacy Policy are the full agreement between you and us about LuckyFish gifts. If any part is found unenforceable, the rest still applies.
